TERMS AND CONDITIONS – E-TRIKE RENTAL

  1. General

1.1 These Terms and Conditions govern the rental of E-Trikes from E-Trike Tours (“the Company”). By renting an E-Trike, the customer (“the Renter”) agrees to abide by these terms.

1.2 The Company provides well-maintained E-Trikes for rental; however, all use is at the Renter’s own risk. The Renter assumes full responsibility for their use of the E-Trike and any consequences thereof.

1.3 The Renter must be at least 18 years old and possess valid identification. However, individuals under 18 may ride an E-Trike if accompanied by an adult for the full rental period and if the Company deems them capable of safely operating the E-Trike. The accompanying adult assumes full responsibility for the minor’s use of the E-Trike.

  1. Risk Acknowledgment & Assumption of Responsibility

2.1 The Renter acknowledges that riding an E-Trike involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, and varying traffic conditions.

2.2 The Renter agrees to operate the E-Trike in a safe manner and assumes full responsibility for their safety while using the equipment.

2.3 The Company is not liable for injuries, damages, or losses resulting from normal use, negligence of the Renter, or any third-party actions.

2.4 Wearing a helmet is mandatory and reduces the risk of serious injury.

  1. Rental Period and Returns

3.1 E-Trikes must be returned to the designated drop-off location by the agreed rental end time.

3.2 Late returns will be charged based on the actual duration of use. If a Renter exceeds their original rental period, they will be charged as though they had rented the E-Trike for the total duration taken. Additional hourly or daily charges may apply.

3.3 The Renter is responsible for securing the E-Trike when unattended and ensuring it is returned in the same condition as when received.

3.4 Equipment must not be used on soft sand, submerged in water, ridden through saltwater, or exposed to wet or salt-laden environments that may cause damage to electrical components.

  1. Payment and Security Deposit

4.1 Full payment is required at the time of booking.

4.2 A security deposit of $750 will be authorised on the Renter’s credit or debit card at the start of the rental. This deposit is held to simplify the returns process and cover potential damages.

4.3 In the event of damage to the E-Trike, repair costs will be deducted from the security deposit. If damage costs exceed the deposit, the Renter will be liable for the additional amount, which will be charged to their payment method.

4.4 The Company reserves the right to charge the security deposit in the event of damage, loss, late return fees, excessive cleaning, or unpaid rental fees.

  1. Cancellations

5.1 Weather Conditions: Rentals proceed rain or shine. Refunds will not be issued due to inclement weather. Renters are encouraged to check forecasts before booking.

5.2 Cancellation Policy: The Company will make reasonable efforts to accommodate booking changes where possible; however, once a booking is confirmed, the Company reserves the right to enforce its cancellation policy at its sole discretion.

  1. Renter Responsibilities

6.1 The Renter must comply with all local road rules and wear a helmet at all times while operating the E-Trike.

6.2 The Renter must operate the E-Trike in a safe and responsible manner and not under the influence of alcohol, drugs, or other impairing substances.

6.3 The Renter must inspect the E-Trike before use and report any issues immediately. Failure to do so may result in liability for damages.

6.4 The Renter is responsible for all fines, penalties, or legal infractions incurred during the rental period.

  1. Liability and Indemnity

7.1 The Renter assumes all risks associated with E-Trike use and agrees that the Company is not liable for injuries, damage, or losses resulting from use, except where such liability cannot be excluded by law.

7.2 The Company makes no warranties regarding the condition, safety, or performance of the E-Trikes beyond what is required by law.

7.3 The Renter indemnifies the Company against any claims, damages, or liabilities arising from their use of the rental E-Trike.

  1. Breakdown Assistance Policy

8.1 In the event of a breakdown (including a flat tyre), the Company will do its best to arrange a mobile repair service through third-party providers.

8.2 All repair and call-out costs are the responsibility of the Renter.

8.3 The Renter remains responsible for returning the E-Trike to the designated drop-off location by the agreed rental end time, regardless of breakdowns.

  1. Damage, Theft, and Loss

9.1 The Renter is responsible for any damage, theft, or loss of the E-Trike while it is in their possession.

9.2 In the case of theft, the Renter must file a police report and notify the Company immediately.

9.3 If an E-Trike is lost or stolen, the Renter is liable for the full replacement cost.

9.4 A cleaning fee may apply if the E-Trike or accessories are returned excessively dirty, covered in sand, or damaged due to improper use or neglect.

  1. Termination of Rental

10.1 The Company reserves the right to terminate a rental agreement without refund if the Renter violates any terms, operates the E-Trike recklessly, or presents a safety risk.

  1. Privacy Policy

11.1 The Company collects and retains personal information for booking purposes and service improvements. Data will not be shared without consent except as required by law.

  1. Governing Law

12.1 These Terms and Conditions are governed by the laws of the State of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland, Australia.By proceeding with the rental, the Renter acknowledges and agrees to all the above Terms and Conditions.
